LIVING AREAS:

This clean and comfortable 500 square foot, one-bedroom luxury flat is located on the third floor of a brand new building and just steps from Mission Beach, shops, restaurants, Belmont Park & Beach House. The unit opens up from the front sliding glass doors and has automatic blinds that completely black-out the room for privacy.

This beautiful, brand new one-bedroom penthouse loft has an open feel that was built almost like a studio, but has a large barn door entry to the main bedroom. You will enjoy one of the best views of all of Belmont Park right from the bedroom window! There’s no other property in the area that can even compare!

In addition to brand new finishes and furnishings with a contemporary design, this clean and comfortable Mission Beach Rental features double-pane windows - installed to keep the noise from the nearby Amusement Park to a minimum.

KITCHEN & DINING:

The kitchen is fully stocked with dishes, utensils, and appliances to make you feel right at home when you're cooking. There is a full kitchen that includes a brand new stove and oven, full-sized fridge w/ an ice-maker in the freezer, dishwasher, microwave, toaster, coffee-maker and nutribullet. Essential dishware, silverware, cooking utensils, pots and pans are also provided to make you feel right at home when cooking. A few basic pantry items such as cooking oil, salt and pepper are provided inside the fold out table attached to the wall.

BEDROOMS & BATHS:

There is one bedroom with a queen size bed. The main living room has a large leather couch that pulls out to a queen, and a futon that pulls out to a twin. The unit sleeps 5 comfortably. There is a full bathroom attached to the bedroom. The bedroom has a built-in closet with plenty of room to hang clothes, in addition to a full dresser in the bedroom. In addition, a 55" TV is hanging above the closet in the bedroom.

OUTDOOR AREAS:

There is a private roof deck area right outside the sliding glass door with spectacular panoramic views of the ocean, Belmont Park, Mission Bay and La Jolla. You can see the Roller Coaster all lit up at night right across the parking lot only 100 yards away.

EXTRA AMENITIES & DETAILS:

The condo has 2 Smart TVs equipped with expanded cable package and Netflix. WiFi is also available. Linens and towels are provided for your stay and there are extras in the bedroom closet. A stacked washer and dryer is also inside the unit, giving you all the basic comforts you would have at your own home!

GARAGE & PARKING:

A 3 spot car-port is located behind the building in the alley directly behind Sandbar, the restaurant closest to the property. If you have 2 cars, street parking is available - yet sometimes hard to find, but there is also a free overnight parking lot ~¼ mile away (See a parking map of the area in the photos above). Make sure you read all parking signs, as the main lot at Belmont park tows every night at 3am!

THE LOCATION:

Mission Beach is the center of fun and activity out of all the San Diego beach communities. The boardwalk and beach are less than 100 steps away and is always bustling in the summertime. Belmont Park is an amusement park that features the Giant Dipper wooden roller coaster, mini-golf, a zip line, rock climbing wall, ropes course, arcade and more - all located right around the corner!

Upon arrival, you will be given easy access to information to get into your rental. It will be professionally cleaned and ready for you to enjoy before you walk inside. Expect to have everything you would get if staying in a 5-star hotel, including shampoo, soaps, paper products, towels, and linens.

Cleaning & Linen Service Policy:

The home is provided with pillows, linens, blankets, towels, kitchen towels, comforters, hand towels and washcloths including extras located in closets. A cleaning service to clean the house and linens on your departure is included on your invoice. You are responsible that all debris, rubbish and discards are placed in plastic bags, and soiled dishes and cooking utensils are placed in the dishwasher and cleaned.

It is standard for beds to be made for guests arrival as part of the linen and cleaning service included in the required fees item in your booking total.

The home is provided with a starter set of toilet paper and paper towels. Owners do not guarantee that these extra items will always be available, and guests may need to replenish their own paper goods, toiletries, and laundry detergent, etc.

EARLY CHECK-IN/LATE CHECK-OUT: **PLEASE NOTE** Due to the nature of last-minute bookings and the cleaning schedule, EARLY CHECK-IN IS NOT AVAILABLE. However, you will be notified the morning of your arrival as soon as the unit is confirmed cleaned and ready for check-in.

LATE CHECK-OUT IS NOT AVAILABLE as the cleaning service will arrive shortly after the 10am check-out time (usually by 10:30am) to prepare the condo for the next guests.

Other Terms & Conditions


GOOD NEIGHBOR POLICY:

*Max Occupancy is 5 persons: No more than 5 guests in the unit at any given time - immediate action for violating the terms in the Rental Agreement will be taken, as there is zero-tolerance policy for excess persons, noise after quiet hours, and disrespecting nearby residents and neighbors who live in this community.

*STRICT QUIET HOURS start at 9PM on weekdays and 10pm on weekends.

*NOISE IS THE MOST SERIOUS ISSUE: First, we need to reiterate that this is NOT a party house. We have had complaints from the neighbors in the past about guests throwing parties or being loud late at night. This is simply not allowed. If your group is loud and disrespectful, I will get a call from the neighbors and you will be asked to leave, forfeiting your deposit. We take this very seriously and you should too. If you have any questions or concerns, please contact me at any time.

*PLEASE CLOSE ALL WINDOWS AND BALCONY GLASS DOORS THROUGHOUT THE CONDO if you are playing music or talking loudly, and walk outside to assess your noise level. Turn down all music after 10pm.

*NOISE COMPLAINT FINE OF $500-$1500: Any formal noise complaint issued by neighbors or City Officers will result in a $500-$15000 fine deducted from the security deposit. Police have the right to fine EACH guests an additional amount up to $1,000 for first time noise complaints. Noise travels far at night.

*There will be no warnings (consider reading this your first warning).

*1-Strike policy applies for noise violations. You MUST abide by all items listed in the Rental Agreement. 1st offense is the forfeit of $500 of your security deposit.

*Second offense will be an additional $500, the police will be contacted and a complaint will be filed, and you will be asked to leave for violating the terms of the Agreement.

*If you refuse to leave and do not vacate the property, or have more than 2 violations issued, we will issue a 3rd $500 fine for a total of $1,500 and the police will be called to arrive at the house. Before they arrive, it would be wise to vacate the premises. In this case, property managers reserve the right to remove your personal items from the property until the police arrive.

* THERE IS A NON-NEGOTIABLE CLEANING FEE FOR EVERY STAY - THIS IS PAID IN ADVANCE TO A PROFESSIONAL 3RD PARTY CLEANING SERVICE (THERE IS NO ROOM TO HAGGLE THE CLEANING FEE).

** WE USE DYNAMIC PRICING SOFTWARE: THIS MEANS THE SET RATE FOR ANY GIVEN NIGHT IS ALREADY EITHER LOWERED OR RAISED FROM STANDARD FOR LAST-MINUTE STAY DEALS, LENGTH OF TRIP DISCOUNTS & HOLIDAYS/PEAK SEASONAL PRICES. PRICES ARE SUBJECT TO CHANGE AT ANY GIVEN MOMENT.

Vacation Rental Agreement

In order to confirm your booking and hold your reservation, we must receive the full deposit and this signed rental contract. Payment of 100% of the total reservation amount listed above is due upon acceptance of this contract by Rent Mission Beach (MANAGER), and you acknowledge, agree to and will abide by the terms listed below.

This Vacation Rental Agreement is entered into as a legally binding agreement by and between the Renter/Tenant, hereinafter referred to as “GUEST(S)”, and the Owner / Manager, Rent Mission Beach (RMB), hereinafter referred to as “MANAGER”.

This agreement constitutes a contract between the GUEST(S) and MANAGER. Please read this Vacation Rental Agreement from top to bottom. Any deposits or advanced payments received by MANAGER for occupancy of vacation rental property stipulates the acceptance and confirmation of the terms and conditions of this Vacation Rental Agreement.

It is the responsibility of the GUEST(S) and their party to be familiar with all policies within this agreement. This occupancy will be in the form of a short-term vacation rental only and not constitute a permanent or primary residence or other tenancy.

We, the Renters / Tenants (also referred to as “GUEST(S)”) agree to the following:


AGENCY / RELATIONSHIP OF PARTIES: It is mutually understood and agreed that MANAGER is acting as Agent only for the property owner and has no liability to either party for the performance of any terms, the premises or covenant of this agreement. Furthermore, GUEST understands MANAGER is being compensated in this transaction by the property owner and is contractually obligated to protect the interest of same. MANAGER hereby discloses to GUEST that should GUEST elect to purchase travel insurance protection or damage insurance through MANAGER, MANAGER may be compensated by provider(s) for cooperation in the transaction.

RESPONSIBLE PARTY & AUTHORIZED USE: GUEST is an adult at least 25 years of age and will be an occupant of Property during the entire reserved period unless other arrangements are approved in writing by MANAGER. GUEST is responsible for the conduct of occupants on the property during the term of the reservation. GUEST and all occupants` valid government-issued I.D. must be presented upon request. No keys or entry code will be issued to anyone who is not an adult at least 25 years of age. Any reservation found to be obtained under false pretenses will be subject to forfeiture of all payments and deposits and the party will be required to vacate the property immediately.

TRANSIENT OCCUPANCY: GUEST expressly acknowledges and agrees that this Agreement is for transient occupancy of the Property, and that GUEST does not intend to make the property a residence or household.
SUBLEASING / SUBLETTING: GUEST is not authorized to let or sublet all or any part of the premises or assign the lease or any interest in it without the prior written consent of the MANAGER.

NO COMMERCIAL USE: GUEST agrees to comply with any and all rules and regulations that are at any time posted on the Premises or delivered to GUEST.

GUEST shall not, and shall ensure that GUEST and licensees of GUEST shall not:
(i) disturb, annoy, endanger, or interfere with other GUEST(S) of the building in which the Premises is located or its neighbors;
(ii) use the Premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband;
(iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the Premises.

MAXIMUM OCCUPANCY: The maximum occupancy (the maximum number of people allowed inside the property at any given time) is listed on your confirmation and in the unit description of each property on the RentMissionBeach website. If your group exceeds the maximum occupancy of the property you rent at any time, your credit card will be charged a fee and you WILL be evicted without a refund.

RESERVATION TRANSFERS: Should the “Renter/GUEST” of this agreement need to transfer the contract for the reservation to another “Renter/GUEST,” a new Vacation Rental Agreement will be produced and a $150 transfer fee shall be assessed.

RENT DUE / PAYMENT TERMS: All rental monies are due according to the payment schedule disclosed under "Payment Policy" on reservation acceptance.

RATE CHANGES: Rates are subject to change without notice prior to receipt of signed agreement and Security Deposit. If a discrepancy arises between the rate quoted on the Site and on the confirmation, the latter will prevail. In the event there is an incorrect rate is due to a typographical or other error, Rent Mission Beach™ shall have the right to refuse, cancel or limit any reservations listed at the incorrect price, whether an order confirmation has been sent and/or payment has been made.

CANCELLATION POLICY: 60 DAYS OR LESS BEFORE CHECK-IN: GUEST(S) will forfeit the total rental. The total rental includes all charges on the paid-in-full invoice. GUEST may mitigate this loss by purchasing Travel Insurance or Cancel for Any Reason insurance offered by a third-party provider.

CANCELLATION 61 DAYS or MORE before check-in: GUEST(S) will receive a FULL REFUND of the amounts paid less any travel insurance fee and minus a credit card processing fee of 3.5%.

EARLY DEPARTURE: There are NO REFUNDS for EARLY DEPARTURE.

TERMINATION OF RENTAL & OCCUPANT(S) OBLIGATION: MANAGER or its agent has the right to inspect and photograph the condition of the premises without prior notice at any time to enforce the terms of this agreement. Should GUEST or any occupants violate the terms of this Agreement, MANAGER may impose fines up to three (3) times the rental amount and may terminate GUEST(S) occupancy immediately with no refunds of rents or security deposits. GUEST shall waive all rights to due process for failure to vacate the premises upon termination and all individuals occupying the Unit will be subject to immediate eviction procedures under California State law. MANAGER or its agent including law enforcement may enter the premises and remove all occupants and their belongings.

DEPOSITS / VACATION RENTAL DAMAGE PROTECTION (VRDP): GUEST is offered VRDP at the time of booking. If, during the dates of occupancy, GUEST causes any damage to real or personal property of the unit or premises as a result of inadvertent acts, and the total cost of damage is not covered by a Security Deposit, the VDRP will be applied to cover the additional cost of repair or replacement of such property up to a maximum benefit of $3,000.00. GUEST must notify MANAGER of any damages prior to check out in order for the VRDP to apply. Any repairs or replacement costs not covered by the VDRP will be deducted from the Security Deposit or be charged to the GUEST.

SECURITY DEPOSITS: MANAGER may impose a refundable Security Deposit in addition to the VDRP at any time prior to or during the dates of stay. If a Security Deposit is imposed, it must be paid to MANAGER upon demand or GUEST will not be allowed to enter or remain in the Unit. The Security Deposit may also be withheld or surrendered should GUEST violate any terms of the agreement, including noise disturbances. The Security Deposit less any deductions will be returned within 14 days of the departure date. If damaged real or personal property is deemed by MANAGER to be intentional or because of negligence, reimbursement will not be covered by the VRDP and will be deducted from the Security Deposit or charged to GUEST.

ALTERNATIVE PAYMENT METHODS: Should MANAGER be unable to recover costs of repairs or replacements from the Security Deposit or credit card on file, GUEST is responsible to provide an alternative method of reimbursement within 48 hours of notification. The VRDP does not cover missing items or damage from pets or allergy/flea/smoking remediation.

CONDITION OF PROPERTY / PREMISES: MANAGER has, to the best of their ability, given an accurate description of the property and its condition. GUEST understands that it is considered as reserved "sight unseen". Our cleaning staff will have cleaned it before your occupancy. All electrical, plumbing and appliances should be in working order. The failures of operation of certain extra amenities, such as TVs, cable, games, or the Internet and WiFi service are not a basis for any refund. MANAGER will make every effort to have these items repaired but does not guarantee that they will be repaired during GUEST(S) occupancy. When you arrive, if you find that the house has not been cleaned to normal standards please notify the MANAGER immediately. We will do our best to have tradesmen attend to the problems but may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. The GUEST agrees to hold the MANAGER harmless from any liability for the condition of the house. Due to the nature of beach properties, the sand, stairs, decks and concrete are not always stable. Use at your own risk.

BEACH CONDITION: GUEST understands that MANAGER has no control over the condition of the beach and cannot be held liable for any changes to beach conditions or any closing as ordered by any official agency.

HURRICANES, HEAT WAVES & TROPICAL STORMS: There are NO REFUNDS for hurricanes, tropical storms or weather conditions such as excess heat, even if a mandatory evacuation is ordered (optional CSA travel insurance is offered for GUEST(S) protection or GUEST may obtain through a third party. GUEST ASSUMES THE RISK).

CONSTRUCTION IN THE AREA: Please note that in Mission Beach there may be construction at this building or other nearby properties. There is a building moratorium in Mission Beach from Memorial Day to Labor Day, so there should not be any major building construction projects going on during this period. However, if there is construction, MANAGER’S are not responsible for any inconvenience due to construction noise or operations on nearby properties and no refunds will be given for this circumstance.

CHECK-IN / CHECK-OUT PROCEDURE: Check-in is at 3:00 PM and checkout is 10:00 AM. A late checkout is subject to extra rental charges at the rate of $100/hour after a grace period of 30 minutes. GUEST`S may arrange for extra nights in advance to avoid any late checkout fees. Extra nights are charged at the daily rate and may be granted if available. If GUEST(S) are not present when cleaning crews arrive and have left their possessions in the house, cleaning crews will collect their possessions and remove them from the premises in order to prepare the unit for incoming GUESTS and GUEST will be charged $150 for this service. PLEASE checkout promptly, the cleaning crews have a very short time window to prepare the unit for new GUESTS. NO LATE CHECK-OUT.

DEPARTURE / CLEANING PROCEDURE: Each property will be inspected, sanitized and cleaned prior to your arrival and after your departure. GUEST should leave the property in the same general condition at Check-In meaning:
-Any debris, trash and discards removed from the home.
-All dishes, kitchenware and cooking messes cleaned up.
-Put back any furniture or items that have been rearranged.
-All remote controls left in plain sight, put back where you found them.
-Refrigerator and unit should be left clean and free of perishable food.
-Lounge chairs equipment, etc. put back in place.
-BBQ cleaned with brush and cover put on.
-Turn-off lights, heater, air conditioner, fans, appliances, etc.
-Please make sure all doors and windows are closed and locked.
-If applicable, leave keys, garage openers, and/or parking passes on the kitchen counter or in the same place you found them.
-If unit is equipped with a lock-box, please return keys to the lock-box.

KEYS: If access to the property is provided by key, GUEST agrees to return the set of keys to the same location after departure. All extra sets of keys should be left in the same location you found them. Lost keys of any kind (door, closet, garage or garage door openers) will incur a replacement fee of $150 deducted from the security deposit for each key needing replacement.

PARKING / GARAGE: Parking is limited to one (1) vehicle. One assigned garage parking space is provided with the rental. GUEST(S) MUST use the assigned garage. Parking in any other space on the property will result in vehicle being towed at GUEST(S) expense. On-street parking is available, and a map of free overnight parking lot will also be available.

ENTRY OF PREMISES: With GUEST`S permission, which is hereby given, MANAGER or MANAGER`S representative may enter the premises during reasonable daylight hours without securing prior permission from GUEST, but shall give GUEST notice of such entry immediately prior if possible and immediately thereafter. For inventory and maintenance purposes a property management employee of the MANAGER may need to enter the premises. The same permission procedure applies as above.

EMERGENCIES: In any emergency, MANAGER or MANAGER`S servicing agents may enter the premises at any time without permission of GUEST for the purposes of making repairs to alleviate such emergency. If GUEST abandons or vacates premises, MANAGER may, at his option, terminate this agreement, re-enter the premises and remove all GUEST`S property.

CHILD PROOFING: GUEST understands that no special efforts have been made to “childproof” this house, and accept the risk or harm to any children we allow on the property. These risks are not limited to, but include access to the ocean, pool, adjacent street, cleaning supplies in the house and plants in the house, patio and on the street, that might be poisonous if ingested.

PROVIDED AMENITIES / LIMITED SUPPLIES: The property is fully furnished, and includes ready-made beds, 1 set of bath towels per guest and an equipped kitchen. Furnishings and amenities are not new and may exhibit signs of wear and tear. Amenities and furnishings are subject to change, and may or may not be the exact same as represented due to replacement, substitution or other reasons. MANAGER provides a starter kit of soaps, dish detergent, laundry soap, shampoo, toilet paper, paper towels, and other disposable items. Since a limited supply is provided, GUEST should plan to shop to replenish these items if necessary. MANAGER assumes no responsibility for the quality or content of any food products left on the premises and GUEST(S) use and/or consumption of the same is not recommended and shall be at GUEST`S own risk(s). Towels (except beach towels) and linens are not to be taken from the units.

USE OF EXTRAS / PROPANE TANKS: Please bring your own beach equipment. GUEST(S) will furnish their own beach towels, beach chairs and beach shades (EZ UPs, umbrellas, etc.). For an additional charge, you can book a Beach Day Package or Bonfire Party Package by contacting Rent Mission Beach™.
Propane: An initial supply of propane tanks are provided at the property for any properties that have outdoor grills and/or fire pits, which may or may not be full upon arrival. However, if tanks are empty or run out during occupancy, GUEST(S) are responsible for refilling the tanks to use for the grill or fire pit. Most nearby gas stations provide propane refills.

TELEPHONES / LANDLINES: Telephones are not customarily provided. Many Units are located in areas with poor cell phone coverage. Please verify with MANAGER if a landline is necessary or you are concerned with cell phone signal strength.

CLEANING, REPAIRS & MAINTENANCE: All homes have cleaning included in the total rent. If additional cleaning is required after you leave, it will be charged to your credit card. GUEST agrees to keep the house, furniture and furnishings in good order. Removing, adding or changing furniture without MANAGER`S written approval shall be deemed a material breach of this Rental Agreement, and is strictly prohibited. GUEST is responsible for cost of replacement of any damage to furniture or premises and replacement of missing items. Under no circumstances can any furnishing or linen be taken outside onto the beach except for those items specifically mentioned in paragraph 8.

SYSTEMS / FURNISHINGS / AMENITY FAILURES: In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, furnishings or amenities, MANAGER will make every reasonable effort to repair or replace the failed system or equipment, and in such event, GUEST agrees to permit MANAGER or its service provider to have reasonable access to the property to inspect and make such repairs. Neither the property owner nor the MANAGER shall be liable to the GUEST for damages, and no refunds will be given for such failures.

OTHER / UNFORESEEN OCCURRENCES: MANAGER does not accept liability for any loss or damage caused by but not limited to the following: weather conditions, natural disasters, pests, construction disturbances, acts of God, or other reasons beyond its control. shall be no refunds of rents because of shortened stays, ruined expectations, or departures due to work and family emergencies, unavailability of any or all parts of the Unit, or any other reasons. It is highly recommended that GUEST considers the purchase of travel insurance.

GUEST(S) NOTIFICATION RESPONSIBILITIES: GUEST and their party shall behave in a civilized manner and shall be good neighbors, respecting the rights of the surrounding neighbors, and shall not create noise or disturbances that interfere with the quiet enjoyment of their property. Outdoor noise or noise carrying outside from inside the home should be kept to a minimum regardless of the hour and in compliance with the local Noise Ordinance. Any use of the unit for any unlawful purpose including, but not limited to the possession, serving, or consumption of alcoholic beverages by persons less than 21 years of age, house parties or keg parties, beer pong, or use of common areas in a manner contrary to the provisions of this agreement, or the rules of the homeowner’s association, are prohibited.

JOINT & INDIVIDUAL OBLIGATIONS: If there is more than one GUEST, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other GUEST.

MULTIPLE HOME RENTALS: Should GUEST or acquaintance of GUEST rent another house in proximity to Unit, no items shall be moved from house to house. GUEST(S) moving between the premises will refrain from loud noise and boisterous behavior. GUEST(S) from two or more rentals will not spend the bulk of their rental time at a house other than the house in which they are sleeping (violation of the occupancy rules). Having too many GUESTS in one house creates extra wear and tear, risk of sewer problems and noise complaints.

TRASH / GARBAGE; DUMPSTERS & RECYCLING: GUEST shall dispose of all waste material generated during the rental period lawfully and put the trash in the exterior trash bins provided for pickup. See the GUEST Information Binder in the unit or contact MANAGER for garbage collection days. GUEST is cautioned not to leave trash outside for long periods of time because it attracts animals.

NO PETS ALLOWED: If you bring a pet(s), this rental agreement will be forfeited, terminated and deposits will be retained and a deep cleaning fee will apply.

NO-SMOKING / NO PARTIES: This is a NON SMOKING vacation rental. Evidence of smoking, such as the smell of cigarette or cigar smoke inside the home by the cleaning crew is a sufficient basis to charge the renter for smoke cleanup and removal from carpeting, AC ducts & filters and furniture. This type of clean up is expensive and GUEST is Liable for the deep cleaning costs incurred. There will also be a $100 charge added on top of the cleaning costs incurred.

GOOD NEIGHBOR POLICY (ZERO TOLERANCE NOISE POLICY): This is not a party house. The GUEST must be 25 years of age to book any vacation rental managed by RMB. Any special occasions such as weddings, receptions, family reunions or increase of occupants (GUESTS not registered on registration form) must be disclosed at the time the reservation is made and is subject to MANAGER`S advanced approval. Prom parties, fraternity or sorority parties and graduation parties are not allowed at any time. Adults cannot rent property on behalf of underage GUESTS, no exception. Noise ordinance starts at 10 pm.

Excessive noise, house parties, or violation of any of the terms of this agreement will be grounds for imposition of a minimum $500.00 fine and/or immediate termination of occupancy and/or forfeiture of the Security Deposit.

NOISE, TRANSMISSION & ORDINANCE: GUEST is aware if the Unit is located in a high-density neighborhood (as are many beach vacation rentals) and is therefore subject to noise from adjacent residences/businesses. If Unit has another unit adjacent or above, noise may travel between walls and/or floors and cause disturbance.

FIRE EXTINGUISHERS: The property is equipped with a minimum of one (1) fire extinguisher. The fire extinguisher was fully charged at the last inspection. It is the duty of the tenant to locate fire extinguisher, notify all other occupants and GUESTS of the location, and to inform management immediately should the fire extinguisher be missing, or be less or become less than fully charged.

SMOKE DETECTORS / CARBON MONOXIDE DETECTORS: The property has smoke detectors and a carbon monoxide detector installed and they are believed to function properly at the time of rental. GUEST will notify management without delay if detectors are missing, uninstalled, “chirps” or have a low battery condition.

SECURITY / USE OF CAMERAS: GUEST(S) understand and accept that the property may be protected with outside security cameras. These cameras are used to protect the property from potential break-ins and theft. There are NO cameras inside the house.

NEW LOCKS / ALTERATIONS: GUEST shall not make or permit to be made any alterations to the Premises or change or add any lock without prior consent of MANAGER.

TV / CABLE / INTERNET / SATELLITE: If provided, no refund of rents shall be given for outages, content, lack of content or personal preferences with regard to cable/internet/satellite service. Services are provided as a convenience only, and are not integral to this agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service.
AIR CONDITIONING / HEAT: Most beach vacation rentals are not equipped with air conditioning. If so equipped, GUEST agrees that Air conditioning shall not be set below 72 degrees and heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation.

FURNITURE / APPLIANCES: Do not move or remove furniture. All furniture must be returned to its original location on GUEST`S departure or an additional charge will be made. Also, please do not remove any appliances in either the kitchen, living/dining room, bedrooms or bathrooms. Please leave all appliances in the same place you found them.

POOL / SPA RULES: If so equipped, GUEST agrees not to tamper with pool heat controls or manipulate heater in any way. Pool heat shall not exceed 86 degrees. GUEST understands that the area surrounding pool and spa may not be fenced or guaranteed to be secure and GUEST will be responsible to ensure supervision of any occupants that may be endangered (see section 35). GUEST also understands and agrees to be responsible and liable and will pay MANAGER upon request for any damages that occur to the pool and spa and its support equipment through misuse and/or negligence.

OTHER COMMON AREAS: GUEST(S) are responsible for keeping all common areas clean and organized. If you are renting a property that shares common spaces with other vacation rental units, please be aware this goes for all occupants at the building. If common areas are dirty upon arrival be advised this does not reflect the cleaning service fee you paid in your reservation.

CHARGING ELECTRIC VEHICLES: Utilizing electrical outlets to charge vehicles is prohibited without pre-approval in writing. GUEST will assume any and all liability and be subject to additional fees in this event.

OWNERS PROPERTY: GUEST agrees not to access the “owner’s closet”, even if unlocked, which contains owners personal property and may contain cleaning supplies and chemicals that could be hazardous to children and adults.

PERSONAL PROPERTY: GUEST understands that any personal property of and used by GUEST is not insured by MANAGER and MANAGER shall not be responsible for any lost, stolen or missing property of the GUEST or property of GUEST left after check out.

LOST / MISSING ITEMS: GUEST(S) will be charged for any missing items reasonably attributable to GUEST(S) and not returned after notification. The cleaning service performs an inventory/survey of the property after GUEST(S) depart and notifies the MANAGER of any missing items. MANAGER will notify GUESTS in the event that items were inadvertently taken, and provide GUESTS the opportunity to return the missing items.

HOLD HARMLESS / INDEMNIFICATION: GUEST agrees to indemnify and hold harmless MANAGER for any liability arising before termination of this Rental Agreement for personal injuries or property damage caused by the negligent, willful or intentional conduct of GUEST(S). This indemnification agreement does not waive MANAGER`S duty of care to prevent personal injury or property damage when that duty is imposed by law.

ASSUMPTION OF RISK / PERSONAL INJURY: GUEST(S) understand that the Homeowners are not responsible for any personal injury caused by slipping on wet pavement or surfaces, and that tenants are responsible for exercising care when surfaces are wet or slippery due to weather or use of hoses to wash down areas, and further, that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, tenants’ failure to take adequate precautions around wet areas, or any unforeseeable circumstances.

WAIVER, RELEASE OF LIABILITY: For spas, hot tubs, swimming pool, sauna, pond, decks, railings, bunk beds accessible by ladders, etc. herein referred to as Special Feature. If so equipped, it is the GUEST`S responsibility to learn about safety precautions concerning utilizing or being around Special Feature. GUEST understands that the area surrounding Special Feature is not fenced or secure, and there are special risks that may be involved for anyone, in particular children who are not carefully supervised, person(s) intoxicated, on any kinds of drugs or medication, with health risks or if pregnant. GUEST agrees to explain the risks of the presence and use of Special Feature to all GUESTS at the property. GUEST agrees to instruct all GUESTS on premises to not access any off-limit, or unsafe sections of the property including roof-tops. GUEST agrees to assume all responsibility to make aware all occupants aware of risks and for the consequences of those risks and to be fully and solely responsible for any accidents that may occur. GUEST agrees to waive any claim whatsoever against property owner or MANAGER for injuries or claims.

UNAVAILABILITY: RESERVATIONS NOT FULLY GUARANTEED: If for any reason, the Property is not available or becomes unavailable or uninhabitable for the reservation dates, every effort will be made to locate substitute accommodations. If the substituted property rents for more for the same period, or remaining period respectively, GUEST will have the option to pay any additional charges or cancel the reservation within 72 hours of notification of GUEST by MANAGER. However, if the substituted property rents for less for the same period, the difference will be refunded to GUEST. In any event, the sole remedy for any perceived damages, liability, or inconvenience is a full refund of the rental amount upon GUEST cancellation. It is highly recommended that GUEST considers the purchase of travel insurance.

SALE/LEASE OF PROPERTY: If unit is actively listed for sale or lease, MANAGER may notify guest to schedule and show property.

HOLDING OVER: Because of the nature of MANAGER`S business (short term winter and summer recreational rentals) GUEST understands, and is hereby put on notice that any unauthorized "holding over" of the property past the stated rental period could severely jeopardize MANAGERs business and cause loss of rental income from other previously booked GUESTS, temporary and/or permanent loss of business, goodwill and reputation and, among other things, could force MANAGER to breach an agreement with similar short term summer and winter recreational GUEST(S) who may have reservations during GUEST`S unauthorized "holding over" period. In the event, MANAGER may be legally liable in damages to said other GUESTS. GUEST(S) should be aware that unauthorized "holding over" has been construed as a factor in establishing "malicious continuing occupation" of rental property, which may entitle MANAGER to treble damages in any unlawful action. GUEST also recognizes the unauthorized "holding over" could be grounds in court as a cause of action for intentionally interfering with MANAGER`S prospective business advantage. In addition, we will charge $100.00 an hour past 10:30 a.m. on day of check-out.

MEGAN’S LAW DATABASE DISCLOSURE: Notice: Pursuant to Section 290.46 of the Penal Code, information about specified registered sex offenders is made available to the public via an Internet Web site maintained by the Department of Justice at website. Depending on an offender’s criminal history, this information will include, either the address at which the offender resides or the community of residence and Zip code in which he or she resides. Neither RMB nor MANAGER`S are required to check this website. If Occupants want further information, Occupants should obtain information directly from this website.

PRIOR AGREEMENTS: No prior agreement or understanding not contained in writing herein shall be effective. Furthermore, MANAGER, other than what is specifically written and set forth herein, makes no other or further representation regarding the nature, character and quality of the premises to be rented, and no representation shall be deemed to exist or be material unless and until it is reduced to writing and signed by the parties. This Rental Agreement may be modified in writing only, and must be signed by the parties in interest at the time of the modification. It constitutes the entire agreement of the parties. If any provision in this contract held by any court to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force.

WRITTEN EXCEPTIONS: Any exceptions to the above mentioned policies must be approved in writing by a MANAGER in advance.

CREDIT CARD AUTHORIZATION: GUEST agrees to provide MANAGER with a valid credit card and MANAGER is authorized to charge any rental amounts due, security deposits, taxes due, fines, and any and all amounts above and beyond the Security Deposit and not covered by the Security Deposit Insurance Plan for extra cleaning, missing and or damaged items and property.

DISPUTES & REMEDIES: In the event of a default to the Rental Agreement, particularly, but not limited to GUEST(S) unauthorized "holding over" or those acts mentioned above in this agreement, and in addition to all other rights and remedies MANAGER may have at law, MANAGER shall have the option, upon written notice or as the Law may hereinafter provided, MANAGER may immediately re-enter and remove all persons and property from premises. In such an instance, the Rental Agreement will be terminated, and MANAGER shall be entitled to otherwise recover all damages allowable under the Law. The GUEST, as part of the considerations of this special rental, in recognition that this property is booked in advance by other GUEST(S) throughout the year, hereby waives all claims for damages that might be caused by MANAGER; re-entry and taking possession of premises or removing or storing property as herein provided, and will hold MANAGER harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry as defined in the California Code of Civil Procedure or other similar statutory provisions. Further, if for any reason MANAGER is unable to deliver possession of the premises to GUEST at the commencement of the term specified in the Rental Agreement, MANAGER shall refund amounts paid by GUEST, but shall not be liable for any other damages caused thereby.

ATTORNEYS FEE / DEFAULT: If any legal action or proceeding (including default, non-payments, etc.) arising out of or related to this Rental Agreement is brought by either party to this Rental Agreement, the prevailing party shall be entitled to receive from the other party, in addition to all other relief that may be granted, the reasonable attorney’s fees, costs and expenses incurred in the action or proceeding by the prevailing party.

FORUM SELECTION, JURISDICTION, LAW & VENUE: The parties agree to the exclusive jurisdiction and venue of the District Court of the State of California for the resolution of all disputes arising under this Agreement. The sole and exclusive venue (i.e. place where lawsuit may be filed) for any legal proceedings shall be in the County of San Diego County, California. GUEST expressly waives any other right or privilege with respect to the election of venue or court (i.e. state or federal) and the location of the venue of action.
GOVERNING LAW: It is expressly agreed that this Agreement shall be governed and construed by the laws of the State of California only, irrespective of the state of residency of GUEST.

ADDITIONAL TERMS & CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges MANAGER and MANAGER from any and all claims, demands and causes of action by reason of any injury or whatever nature which may have occurred to the undersigned, or any of his/her occupants or GUESTS as a result of, or in connection with the occupancy of the premises and agrees to hold MANAGER and Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

ACCEPTANCE OF TERMS & CONDITIONS: Facsimile signatures are deemed original signatures and approving online terms and conditions constitute approval of these terms and conditions. Furthermore, by checking the box and clicking on the "I AGREE" button, GUEST is consenting to the use of an electronic signature in lieu of an original signature on paper and is obligated to all financial and all other provisions of the Terms and Conditions. GUEST may request to sign a paper copy instead. By checking the I AGREE button, GUEST waives that right. After consent, GUEST may, upon written request to MANAGER, obtain a paper copy of the electronic record at no charge. GUEST(S) agree that use of an electronic signature for any documents will continue until such time as GUEST notifies MANAGER otherwise in writing. is no penalty for GUEST withdrawing this consent. GUEST should always ensure that MANAGER has a current email address on file in order to contact GUEST regarding any changes, if necessary.

This agreement and disclaimer applies to GUESTS and all persons in the GUESTS’ party.

Under no circumstances will GUESTS or their party hold the Owners of the properties managed by Rent Mission Beach™ Vacation Homes responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.

GUEST(S) understand that Owner and management are always striving to fix any issues right away that may come up during your stay. NO REFUNDS will be issued for minor inconveniences.

Any penalties issued from HOA that come from issues during your stay that result in any fines and/or fees will be paid by the GUEST out of their security deposit.

GUEST CERTIFICATION FOR HOTELS AND LODGING ESTABLISHMENTS
Under Executive Order N-33-20 issued by the Governor of the State of California, and by Order of the State Health Officer (“Stay-at-Home Order”), all individuals in the State of California are to stay at home or in their place of residence except as needed to maintain the continuity of operations of the federal critical infrastructure sectors. Hotels that are used for COVID-19 mitigation and containment measures, treatment measures, providing accommodation for essential workers, or providing housing solutions, including measures to protect homeless populations are essential under the State orders.

The State Health Officer has set out California’s path forward from this Stay-at-Home Order in California’s Pandemic Roadmap. That Roadmap identifies four stages of the pandemic: safety and preparation (Stage 1), reopening of lower-risk workplaces and other spaces (Stage 2), reopening of higher-risk workplaces and other spaces (Stage 3), and finally an easing of final restrictions leading to the end of the stay at home order (Stage 4).
Hotels are higher-risk workplaces and may not be open for non-essential purposes until Stage 3.

By Order of the San Diego County Public Health Officer all hotels and lodging establishments must require guests to certify that they are staying in the hotel in compliance with the “Stay-at-Home Order.”

I certify under penalty of perjury under the laws of the State of California that the foregoing is true and correct and that I meet one of the following categories:

• I am an essential worker needed to maintain the continuity of operations within San Diego county in one of the federal critical infrastructure sectors found on their website, or:
• I am homeless and seeking shelter; or
• I have been exposed to COVID-19 and I am isolating myself from others; or
• My primary residence is unsafe due to the condition of the residence or because I am at risk of abuse or a household member accompanying me is at risk of abuse.
• And (if applicable), any person who will stay in my guest room is a member of my household.

Any person who knowingly misrepresents that they meet the criteria above, and any hotel or lodging establishment that knowingly permits a guest to stay in violation of the “Stay-at-Home Order” are subject to fine or imprisonment. (California Health and Safety Code section 120295.)
